The Bankruptcy Way Out
By Patrick Mead
4-4-13

Filing for bankruptcy can be the easiest way out of debt or foreclosure! Certain assets are automatically exempt from creditors, no matter how much you owe. Whether or not your
assets are safe from creditors, hiding them is unacceptable. If transfers of assets have been made in the recent past, you are well advised to wait 12 months before filing for
bankruptcy. If you cannot make your payments, bankruptcy will stop collectors from calling you while your case is pending. It can be stressful to be in credit card debt. Sometimes
entering bankruptcy protection will be the easiest way to stay sane while getting things together. Learn of new Massachusetts bankruptcy laws (like the new Automatic Homestead!)
prior to deciding to file for bankruptcy in Massachusetts. The laws are constantly undergoing changes, so you must stay on top of them if you are going to file for personal
bankruptcy correctly. To learn about these changes, try contacting your state's legislation office or checking their website. If you are facing a more serious bankruptcy situation like
a foreclosure auction, Chapter 13 may be an option depending upon your income and expenses. Chapter 7 may also be an option to stop foreclosure, but this will only be a
temporary reprieve until the mortgage company (Bank of America, Chase, Wells Fargo, etc.) gets "relief from the automatic stay." The Automatic stay can be relieved in Chapter 7
(or Chapter 13 if you fail to pay your mortgage) by way of a motion filing in the Mass. Bankruptcy Court.
